Why Should I Not Talk to the Police?

Many people believe that if they talk to the police it will be better for them. Some feel that if they don't talk to the police someone will hold that against them. Nothing can be further from the truth.

NEVER, NEVER, NEVER talk to the police without your experienced criminal defense lawyer being present.

Police go through a lot of training to try to convince people to talk to them and infer that cooperation will be beneficial. The only benefit is to the police and District Attorney.

ALWAYS insist that you want a lawyer before you say anything, whether or not the police tell you that you have the right to have a lawyer present or that you don't need or have the right to a lawyer.

ALWAYS demand that you want a lawyer present before you say anything.

DO NOT AGREE to write a letter of apology or otherwise admit anything.

If you insist on your Constitutional right to remain silent and demand a lawyer, that fact cannot be made known at any trial. To do so is prosecutorial misconduct and is virtually an automatic reversal of any conviction.
